LA County opens FAIR Plan wildfire-claims investigation
County Counsel is examining the insurer’s handling of claims from the 2025 Eaton and Palisades fires after residents reported delays, underpayments and denials.
Los Angeles County announced Wednesday that County Counsel has opened an investigation into the California FAIR Plan Association’s claims practices for policyholders affected by the January 2025 Eaton and Palisades fires.
Agency: Los Angeles County Counsel
Focus: Potential violations of California’s Unfair Competition Law
Claims involved: Eaton and Palisades fire losses
Status: Investigation announced; no violation has been established
What the county is reviewing
The county said the inquiry follows resident complaints about delays, underpayments, denials and refusals to cover testing or remediation for toxic contamination. County Counsel has asked the FAIR Plan for information and records about its business practices.
The announcement does not establish that the FAIR Plan violated the law. The investigation is intended to determine whether its practices were unlawful or unfair and whether any corrective action, restitution, penalties or court orders are warranted.
Why the FAIR Plan matters
The FAIR Plan is a private association of California property insurers that provides last-resort coverage to homeowners who cannot obtain insurance in the regular market. Los Angeles County said this is its third action involving an insurer’s treatment of 2025 wildfire claims, following a lawsuit against State Farm and a separate investigation into Farmers Insurance.
